This is the European regulation on deforestation. This regulation aims to minimize the consumption of products from supply chains associated with deforestation or forest degradation, while encouraging demand for and trade in legal, “deforestation-free” raw materials and products.
Wood, cocoa, coffee, rubber, palm oil, soya, beef and certain of their derivatives which contain, have been added with or have been manufactured using the commodities concerned as set out in Annex I to the Regulation with the exception of : - Products manufactured before 29/06/2023. For wood products covered by the EUTR, this will prevail until 31/12/28. - Products manufactured on or after 30/06/2023 and placed, made available or exported before 30/12/2025 for large and medium-sized companies and 30/06/2026 for small companies. For wood products subject to the EUTR, this will prevail until 30/12/2025 (30/06/2026) as well as those placed, made available or exported after 30/12/2025 if the basic products from which they are derived were placed on the market between 30/06/2023 and 31/12/2025 (30/06/2026). For wood products, the EUTR will continue to apply. - Goods and products not listed in Annex I".

The EUDR was adopted by the European Union in May 2023 and will come into force on 30 December 2025. Micro and small businesses will be granted a 6-month extension.
Operator: Any natural or legal person who, in the course of a commercial activity, places the (basic) products in question on the EU market for the first time or exports them. This includes importers, producers and exporters. Trader : Any person in the supply chain other than the operator who, in the course of a commercial activity, makes the products in question available on the EU market for distribution, consumption or use, whether in return for payment or free of charge.
The regulation provides for severe penalties in the event of infringement, including fines of up to 4% of annual EU-wide turnover, confiscation of the products concerned or the revenue derived from them, and temporary bans on public tenders, public funds, and the placing on the market or export of the products in question. The European Commission will also publish the names of legal entities that have infringed the regulations and for which a final judgement has been handed down. This will increase the risk to the reputation of the company concerned.
With regard to the legality requirement for land use, the Regulation requires compliance with the relevant national laws. If possession of a land title is not required under national law to produce and market agricultural products, neither is it required under the Regulation. The same applies to public or communal land, which does not fall under the concept of "immovable property". The absence of a land register or official title should not prevent the designation of land used de facto as a plot of land. Operators (or traders who are not SMEs) are legally responsible for the accuracy of information relating to geolocation and legality, regardless of the means or intermediaries they use to collect this information.
